Board Certified in Health Law, Robert Spurck represents hospitals, physicians, dentists, and other health care providers in all facets of their business. His practice spans business transactions, federal and state regulatory matters, day‑to‑day compliance, and contractual and operational issues that arise across the life cycle of a health care enterprise. Robert also advises public health care facilities on public law questions, including public information requests and open meetings issues, giving him a nuanced view of how legal requirements intersect with governance and community expectations.​​

Navigating Fraud, Abuse, and Regulatory Risk
Robert regularly counsels clients on fraud and abuse concerns under the federal anti‑kickback statute and physician self‑referral (Stark) laws, as well as HIPAA and other privacy and security requirements. He helps structure relationships and transactions to fit within safe harbors, exceptions, and enforcement priorities, and he works with clients to build compliance practices that are sustainable in day‑to‑day operations. When issues escalate, Robert assists providers in responding to government investigations and subpoenas, drawing on both his regulatory experience and his earlier background as a commercial and insurance coverage litigator.​

Supporting Business Transactions and Emerging Models
A significant portion of Robert’s work involves the formation, purchase, and sale of health care facilities and dental practices, as well as the formation and operation of new entities and joint ventures. He regularly guides clients through entity selection, deal structure, and closing, helping them align regulatory requirements with business goals. Robert also has experience with the regulation, formation, and operations of Accountable Care Organizations and other value‑based care arrangements, advising on both the corporate and compliance aspects of these models.​

Perspective from Public Service and Industry Engagement
Robert currently serves as Vice‑Chair of the Texas Medical Disclosure Panel, which determines the risks and hazards that must be disclosed to patients for certain medical and surgical procedures and establishes the general form and substance of such disclosures. That service, combined with his active participation in local and state bar associations and the American Health Law Association, keeps him closely connected to the evolving standards that shape informed consent and patient communication in Texas. His work with public hospitals, trustees, and rural facilities—including frequent “Legal Update” presentations for TORCH/TARHC and programs on public hospital issues—gives him practical insight into the operational realities facing boards and executives across the state.​​

Robert has been recognized in Chambers USA for Texas Health Law and listed in The Best Lawyers in America in Health Care Law since 2018. He is Board Certified in Health Law by the Texas Board of Legal Specialization and is a member of the Phi Delta Phi International Legal Fraternity. Before concentrating his practice on health care law, he spent several years as a litigator in insurance coverage and commercial disputes, experience that informs his approach to risk, documentation, and strategy in health care transactions and regulatory matters. A graduate of St. Mary’s University School of Law and The University of Texas at Austin, Robert is admitted to practice in Texas and has represented clients in both state and federal forums.​

Outside the office, Robert serves on the board of the Northwest Austin Youth Basketball Association, reflecting his long‑standing interest in youth sports and community engagement.
